WAW’s panel on the latest developments on evidence in international arbitration will highlight the new developments of evidentiary matters on international arbitration, showing how this field has evolved. Particularly, it will focus on the latest changes in the IBA Rules on the Taking of Evidence in International Arbitration and will discuss the Prague Rules on the Efficient Conduct of Proceedings in International Arbitration. Mainly, the panel will refer to:
- Differences between US-style discovery and international arbitration practices.
- Practical aspects on the evidentiary gathering process in investment and commercial arbitration.
- The role of witness and expert evidence, including that provided by damages experts
- When can a tribunal exclude evidence illegally obtained based on Article 9(3) of the 2020 IBA Rules?
